The importance of reading the fine-print

Home / Resources / The importance of reading the fine print

Businesses who use recruitment agencies need to understand the importance of reading the fine-print of each agency’s terms and conditions.   In many cases these terms do represent a fair service, but there seems to be an alarmingly high number of situations where they don’t – especially surrounding guarantees when candidates leave the company after a short period of time.

To put this in context for you – one of our clients have recently been threatened to pay an outstanding invoice worth thousands of dollars for the placement of a candidate who left one week into their role.  The candidate was hired as a full-time permanent employee in a pivotal operational role within the organisation.   When the candidate disclosed they were leaving to pursue a personal business opportunity, the company had to scramble to find a replacement.  The agency was of little help in addressing this issue, so they ventured down a different option to recruit for this urgent vacancy.  It was at this point they turned to Crackerjacks and subsequently found a replacement, at a fast-turnaround, who fitted into the role seamlessly.

To the company’s surprise, they received an invoice from the agency demanding they pay the full recruitment bill for the candidate who left within one week.  Even though no suitable replacements were presented, it was still expected that the full bill should be paid.  After consulting the terms and conditions they were shocked to see that their acceptance to the terms was inferred by their initial acceptance of CV’s the agency sent them.  Furthermore – there was no discount included that safe-guarded the company from the unfortunate situation that occurred.

Many a company have found themselves in this sticky situation, facing the prospect of paying a hefty recruitment bill for a limited and flawed service.  It is a given that people’s behaviour is highly unpredictable.  Even though there are measures a skilled HR/Recruitment professional will use to help predict behaviour, it is never full-proof.  Hence – it is important, for your peace of mind (and budget) that there is a money back- guarantee or even discount policy in place when investing in staff through suppliers.

The moral of the story is to check that fine-print in the terms and conditions and if you opt to use an agency, make sure you are 100% clear on the terms and negotiate a guarantee package before reviewing any CV’s provided.

At Crackerjacks we offer a 30 day money back guarantee and ensure we keep your staffing investment low by providing a competitive fixed monthly rate, as opposed to a lump-sum based on a salary or hourly rate percentage margins.
